Terms of Service

These Terms of Service ("Terms") govern your use of the Quietful app and the quietfulapp.com website (together, the "Service"), operated by Outhaul LLC, a Florida limited liability company ("Outhaul," "Quietful," "we," "us," or "our"). By using the Service, you agree to these Terms.

1. The Service

Quietful helps people find quieter places to eat, work, and meet, using noise readings submitted by the community. See our Privacy Policy for how we handle your information.

2. Readings are indicative, not calibrated

Decibel readings, tiers, and averages shown in Quietful come from consumer phone microphones, not calibrated measurement equipment, and reflect a moment or a small sample of moments, not a certified acoustic survey. Use them to plan and compare, not as a precise or guaranteed measurement of any venue's noise level. Quietful is not a hearing-safety, compliance, or medical device, and shouldn't be used as one.

3. Anonymous device identity

You do not need an account to submit readings. Submissions use an anonymous device credential for history and abuse controls. You are responsible for activity submitted from your device, and should tell us if you think its credential has been compromised.

4. Acceptable use

You agree not to:

  • Submit fabricated, manipulated, or knowingly inaccurate readings;
  • Use automation, scripts, or modified clients to submit readings or interact with the Service;
  • Attempt to defeat device-integrity or anti-abuse checks (see Section 7);
  • Harass other users or post content that is unlawful, defamatory, or infringing; or
  • Interfere with the Service's normal operation or attempt to access it in unauthorized ways.

5. Your content

You retain ownership of the readings, tags, and any other content you submit ("Contributions"). By submitting a Contribution, you grant Quietful a worldwide, non-exclusive, royalty-free license to host, display, aggregate, and distribute it as part of the Service — for example, showing an aggregated average or hourly chart built from many users' Contributions. You're responsible for making sure you have the right to submit whatever you contribute.

6. Content moderation

We moderate Contributions to catch spam, abuse, and fabricated data, and we may remove content or restrict device access that violates these Terms. You can report a reading or venue entry from within the app. Moderation decisions are made at our discretion and we aim to apply them consistently, but we don't guarantee a particular outcome or timeline for any report.

7. Device integrity checks

To keep venue data trustworthy, Quietful uses Apple's DeviceCheck and App Attest to verify that readings come from genuine copies of the app on genuine hardware, rather than scripted or spoofed submissions. Attempting to bypass, spoof, or interfere with this check is a violation of these Terms and may result in device access being restricted. See our Privacy Policy for how attestation data is used.

8. Venue claims

If you represent a venue, you can claim its listing to correct details or respond to readings. You must have authority to act on the venue's behalf, and you agree not to use a claimed listing to submit, edit, or suppress readings in a way that misrepresents the venue's actual noise levels. We may revoke a claim we believe was made in bad faith or without authorization.

9. Intellectual property

The Quietful name, logo, app, and website, apart from user Contributions, belong to Outhaul LLC or its licensors. These Terms don't grant you any right to use our branding except as needed to use the Service as intended.

10. Disclaimers

The Service, including all readings, tiers, and venue information, is provided "as is" and "as available," without warranties of any kind, whether express or implied, including accuracy, fitness for a particular purpose, or non-infringement. We don't guarantee that any venue's actual noise level will match what's shown in the app.

11. Limitation of liability

To the fullest extent permitted by law, Quietful is not liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service, including decisions made based on a venue's shown noise level.

12. Termination

You may stop using the Service at any time. The current app does not offer account deletion or reading withdrawal, though you can request that your anonymous device identity be de-linked from your past readings — see our Privacy Policy, Section 11. We may suspend or terminate access to the Service for anyone who violates these Terms, including the acceptable-use and device-integrity provisions above.

13. Governing law

These Terms, and any dispute arising from your use of the Service, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute not resolved informally will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms as the Service changes. We'll update the "Last updated" date at the top of this page when we do, and for material changes we'll provide more prominent notice in the app. As with any legal document, we review these Terms periodically with counsel as the product evolves.
